Hearing set in death of Grand Lake 3-year-old
February 12, 2009
A plea hearing has been scheduled for Tuesday, Feb. 24, in the case involving the death of a Grand Lake child last January.
Last October, Michelle Baber of Grand Lake entered a plea of not guilty by reason of insanity to the charge of child abuse causing death.
Baber is accused in the death of 3-year-old Daisai Derzon, a foster child who was in Baber’s care when she died as the result of head injuries last January.
After Baber entered the insanity plea, District Court Judge Mary Hoak ordered Baber to undergo an evaluation by the Colorado Mental Health Institute in Pueblo.
A series of continuances were granted by the District Court so that psychological and medical evaluations could be performed on the defendant. Those evaluations are now complete, according to 14th Judicial District Attorney Elizabeth Oldham.
Derzon’s death followed an incident on Jan. 9, 2008, at Baber’s Grand Lake residence, which was the 3-year-old’s foster home. On that day, the child was rushed by ambulance to the Granby Medical Center for treatment and was subsequently transported to Children’s Hospital in Aurora, where she died Jan. 12, 2008.
