Colo. teen to be tried as juvenile in slaying

COLORADO SPRINGS, Colo. (AP) – A judge has ruled that a 14-year-old Colorado Springs boy accused of fatally shooting his younger brother and wounding his mother will be tried as a juvenile rather than an adult as prosecutors wanted.

District Judge David Shakes issued his decision Monday after considering five days of testimony. He says the boy is an “immature defendant” and that the issue of a sleep disorder raised by his attorneys could be used as a defense.

The boy would have been the youngest inmate in 117 years at Colorado’s Department of Corrections had he been tried and convicted as an adult. He is charged with first-degree murder and attempted murder in the shootings last May.
