Newberry arraignment date set on count of official misconduct

Grand County Commissioner James Newberry’s arraignment hearing on one count of official misconduct, a class 2 misdemeanor, has been set for 9:30 a.m. on May 26 in Grand County Court.

Judge Terry Ruckriegle of Summit County will preside over the case.

Ruckriegle, who oversaw Kobe Bryant’s 2003 sexual assault case in Eagle County, is coming out of retirement to hear the case.



Grand County Judge Nick Catanzarite recused himself, citing a personal and professional relationship with Newberry.

Newberry was charged in relation to allegations that he charged both Grand County and the Colorado River Conservation District for mileage to drive to district meetings.



At the time the charges were filed, it was revealed that a “deferred prosecution agreement” had already been reached, and Newberry will not enter a plea in the case.
