Suspect in child porn case arraigned in District Court

The local man accused of trafficking in child pornography made his first appearance in the 14th Judicial District Court in Hot Sulphur Springs on Thursday.

The case of the 47-year-old Tabernash man had been turned over to the District Court last month after preliminary hearings were conducted in Grand County Court. He had been arrested and incarcerated in the Grand County Jail since early September on the child pornography charges.

In Thursday’s arraignment before District Judge Mary Hoak, the defendant was told to reapply for a public defender to handle his case because he no longer qualified after he bonded out of the county jail on Wednesday, Jan. 2. He had been incarcerated since his arrest on Sept. 5 until he posted the $6,000 bond last week.

Judge Hoak ordered the Tabernash man to make his next appearance before the District Court on Thursday, Jan. 24. In that appearance, he will face two charges ” sexual exploitation of children: possession of materials, and sexual exploitation of children: sell/publish.

Also on Thursday, the Tabernash man was sentenced by Judge Hoak on a second degree trespassing charge that he pleaded guilty to in the Grand County Court on Dec. 19. It was part of a plea agreement worked out with the district attorney’s office.

For the trespassing conviction, the defendant was sentenced to 180 days in jail with credit for 117 days presentence confinement and the remaining 63 days suspended.

He was also placed on one-year of supervised probation, ordered to perform 48 hours of public service and ordered to pay $1,032 in fines and court costs.

The plea agreement on the second degree trespassing charge stemmed from an investigation by the Grand County Sheriff’s Office after deputies discovered a young girl’s panties at the Tabernash man’s residence on Sept. 5 when he was arrested.

Investigators had claimed the man allegedly stalked an ex-girlfriend for several months before breaking into her house to steal the panties belonging to her daughter.

What led to the man’s arrest on the original child pornography charge was information provided to the Grand County Sheriff’s Office by the FBI.

The FBI allegedly identified the Tabernash man through his AOL Internet addresses as the sender and the receiver of child pornography from two other suspects involved in child pornography cases.

Seized under a search warrant of the man’s residence on Sept. 5 were two computers and 230 computer-printed images of “explicit sexual content” involving young girls, according to court documents.
