February 25, 2009
At a plea hearing in Hot Sulphur Springs on Tuesday, attorneys for Michele Baber of Grand Lake agreed to enter a guilty plea on the charge of child abuse – death – negligence in the death of a 3-year-old girl in Baber’s care, according to court documents.
Baber’s sentencing hearing is set for May 1. A sentence has not been stipulated as part of the plea, according to the documents, and any restitution has yet to be determined.
Baber originally entered a plea of not guilty by reason of insanity to the charge of child abuse causing death. The court granted a series of continuances in the case while Baber underwent mental and physical evaluations.
Those evaluations were completed recently, but large portions of the case file are not open to the public.
Baber is accused in the death of 3-year-old Daisai Derzon, a foster child who was in Baber’s care when she died as the result of head injuries in January 2008.
Police responded to an incident on Jan. 9, 2008 at Baber’s Grand Lake residence, which was Derzon’s foster home. On that day, the child was rushed by ambulance to the Granby Medical Center for treatment and was subsequently taken to Children’s Hospital in Aurora, where she died Jan. 12, 2008.
