Garfield County court deputy faces felony charge after alleged road rage incident

Sheriff’s office awaiting outcome of court process before releasing employment details

A Garfield County Sheriff’s Office court deputy was arrested Feb. 8 on suspicion of felony menacing following an alleged road rage incident on Interstate 70, according to court records and the Colorado State Patrol.

Mark C. Fox was booked into Garfield County Jail on a Class 5 felony menacing charge and released later the same day on a $1,000 personal recognizance bond, according to court records.

According to an arrest affidavit, Colorado State Patrol troopers were dispatched around 11:31 a.m. Feb. 8 to a reported weapons violation on westbound I-70 near milepost 100. A driver reported that a man in a red GMC Acadia had pointed what appeared to be a handgun during a road rage incident.



The reporting party told troopers he and Fox had been involved in a confrontation on the highway. He said Fox first pointed his hand as if it were a gun before later pulling out and displaying a handgun, according to the affidavit. The man told troopers he feared for his life and believed the weapon was real.

Troopers used vehicle registration information to identify Fox and went to his residence, where he was taken into custody on suspicion of felony menacing, the affidavit states.



Fox told troopers he had been driving the GMC Acadia and was coming from work at the Garfield County Jail after stopping at a Glenwood Springs hardware store. He also said he always carries a handgun before invoking his right to remain silent, according to the affidavit.

Garfield County Sheriff’s Office Public Information Officer Shannon Stowe on Thursday confirmed that Fox is a court deputy with the sheriff’s office.

Stowe said the sheriff’s office could not yet provide information about Fox’s employment status and was unable to say whether he has been placed on administrative leave or terminated.

“Unfortunately, I don’t really have much information for you until the charges and the judgment is made through the District Attorney’s Office and the judge,” Stowe said. “We’re just at a standstill until then.”

According to court records, Fox is scheduled to appear in Garfield County Court Feb. 17.
